Terms of Use
These Terms of Use govern your access to the NovaSIM websites, mobile apps, and services operated by AM Soft LLC.

1. Agreement and service provider
These Terms constitute a binding agreement between you and AM Soft LLC. By using our services you confirm that you are at least 18 years old, can enter into a binding agreement, and agree to comply with these terms and all applicable laws and regulations.
2. Account responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration information and update it as needed. Notify us immediately at support@novasim.al if you suspect unauthorized use.
3. Service availability and fair use
Coverage, speeds, and availability depend on local carrier networks and device compatibility. We may apply fair-usage policies including data speed throttling after high usage thresholds, or temporarily suspend service to protect network integrity and prevent abuse or fraudulent activity.
4. Payments and billing
All prices are displayed in your selected currency before checkout. By completing a purchase, you authorize NovaSIM and our payment processor to charge your selected payment method. Applicable taxes, VAT, and regulatory fees are calculated and displayed at checkout based on your billing location.
5. eSIM activation and usage
eSIMs are delivered digitally via QR code or activation code. Data plans have validity periods and data allowances as specified at time of purchase. Unused data does not roll over unless explicitly stated. You are responsible for ensuring your device is eSIM-compatible and unlocked.
6. Prohibited activities
You may not misuse the services, including but not limited to: attempting unauthorized access to systems or networks, using the service for illegal activities, reselling or redistributing eSIMs without written consent, operating servers or file-sharing services, or engaging in fraudulent activity.
7. Changes and termination
We may update these terms or modify services to improve quality, add features, or comply with legal requirements. Material changes will be communicated via email or in-app notification. We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
8. Limitation of liability
To the maximum extent permitted by applicable law, NovaSIM is not liable for indirect, incidental, consequential, or punitive damages arising from use of the services, including but not limited to loss of data, revenue, or business opportunities. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Governing law and disputes
These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
